Terms of Service

These Terms of Service govern your access to and use of the Divvy mobile app, the godivvy.app website, and related services (collectively, the “Service”). Please read them carefully before using Divvy.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use Divvy. Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference.
1. Acceptance Of Terms
By accessing or using Divvy, you confirm that you are at least 13 years old, that you have the legal capacity to enter into a binding agreement, and that you agree to be bound by these Terms and all policies referenced herein.
If you are using Divvy on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to both you and that organization.
2. Description Of Service
Divvy is an expense-splitting and group finance coordination tool. It allows users to create trips and groups, log expenses, split bills among participants, track who owes whom, and initiate settlements by launching external payment applications such as Venmo, Cash App, PayPal, and Zelle.
Divvy is a calculation and coordination tool only. Divvy does not process, transfer, hold, or transmit money. Divvy is not a bank, payment processor, money transmitter, or financial institution of any kind. All actual payments occur entirely between users through third-party payment apps that you choose to use.
The Service also includes a public receipt-scanning demo on the website, which uses AI-powered parsing to extract line items and totals from uploaded receipt images.
3. Account Registration And Responsibility
To use the core features of Divvy, you must create an account using a valid email address or phone number. Authentication is handled via one-time passcode (OTP). You agree to provide accurate, current, and complete information and to keep your account details up to date.
You are responsible for all activity that occurs under your account. You must not share your authentication credentials or allow others to access your account. If you believe your account has been compromised, contact us immediately at hello@godivvy.app.
Divvy reserves the right to suspend or terminate accounts that violate these Terms, are associated with fraudulent activity, or have been inactive for an extended period.
4. Acceptable Use
You agree to use Divvy only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Service. The following are prohibited:
- Use the service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to any account, system, or network connected to Divvy.
- Submit false, misleading, or fraudulent expense data, including manipulated receipt images.
- Harass, threaten, or harm other users through the service.
- Reverse engineer, decompile, or otherwise attempt to derive the source code of the app or backend systems.
- Use automated tools to scrape, crawl, or extract data from Divvy in ways not permitted by these Terms.
- Introduce viruses, malware, or other harmful code into any part of the service.
- Use Divvy to transmit unsolicited commercial communications or spam.
- Impersonate another person or create accounts on behalf of others without authorization.
Divvy reserves the right to investigate and take action against any use that violates these Terms, including removing content, suspending accounts, and reporting activity to law enforcement where appropriate.
5. Financial Disclaimer
Divvy is not a financial institution
Divvy calculates expense splits and tracks balances among users. It does not hold funds, process payments, or act as a payment intermediary in any capacity. Divvy is not registered or licensed as a money services business, payment processor, or financial adviser.
External payment apps
When you use Divvy's settlement features, the app deep-links you to external payment applications (Venmo, Cash App, PayPal, Zelle, or others). Any transaction you complete through those apps is governed solely by the terms, policies, and agreements of those third-party services. Divvy has no control over, and accepts no responsibility for, those transactions.
Payment disputes
Divvy is not responsible for disputes between users regarding payments, balances, or settlements. If a payment is sent incorrectly, not received, or disputed, that matter must be resolved directly between the users involved and, where applicable, through the relevant third-party payment platform. Divvy does not mediate financial disputes and has no ability to reverse or facilitate transactions.
Expense balances displayed in Divvy reflect data entered by users and are only as accurate as the information provided. Divvy does not independently verify expense amounts, receipt totals, or the accuracy of user-entered data.
6. User Content
- You retain ownership of the content you submit to Divvy, including receipt images, expense descriptions, and trip names.
- By submitting content, you grant Divvy a limited, worldwide, royalty-free license to store, process, display, and use that content solely to provide and improve the service.
- You are responsible for ensuring your content does not violate the rights of others or applicable laws.
- Divvy may use anonymized or aggregated receipt and expense data to improve parsing accuracy and product features, in accordance with the Privacy Policy.
- We do not claim ownership of your financial data. You can request deletion of your account and associated content at any time.
Divvy may remove content that violates these Terms, is reported as abusive, or that we determine in our sole discretion is harmful to other users or to the Service.
7. Privacy
Your privacy matters to us. Our Privacy Policy describes what information we collect, how we use it, and your choices. By using Divvy, you agree to the collection and use of information as described there.
Key points: we collect the information you provide during sign-up (email or phone), profile details, payment handles you choose to add, expense and trip data you create, and receipt images you scan. 8. Intellectual Property
The Divvy name, logo, app design, website, and all software, content, and materials we create are owned by Divvy and protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in the Service or our intellectual property.
You may not copy, modify, distribute, sell, or create derivative works from Divvy's materials without our express written permission. Feedback or suggestions you share with us may be used to improve the Service without any obligation to you.
9. Third-Party Services And Links
Divvy integrates with or links to third-party services including payment apps, analytics tools, and infrastructure providers. These third-party services have their own terms and privacy policies, and your use of them is governed by those agreements. Divvy is not responsible for the practices, content, or reliability of any third-party service.
The presence of a link or deep-link integration in Divvy does not constitute an endorsement of that service.
10. Disclaimers And Limitation Of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DIVVY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIVVY AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING FINANCIAL LOSSES, PAYMENT DISPUTES BETWEEN USERS, DATA LOSS, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT.
IN NO EVENT WILL DIVVY'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DIVVY IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Divvy and its officers, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your submission of content, or your violation of any third-party rights.
12. Termination And Account Deletion
You may stop using Divvy and delete your account at any time through the app or by contacting us at hello@godivvy.app. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy, subject to retention obligations.
Divvy may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful activity, or for any other legitimate business reason. Sections of these Terms that by their nature should survive termination — including disclaimers, limitation of liability, and governing law — will do so.
13. Changes To These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above. If changes are material, we will make reasonable efforts to notify you, such as through an in-app notice or email. Continued use of the Service after updated Terms take effect constitutes your acceptance of the revised Terms.
If you do not agree to updated Terms, you should stop using Divvy and may delete your account.
14. Governing Law And Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of Divvy that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in California.
Before initiating any formal legal proceeding, you agree to contact us at hello@godivvy.app and give us a reasonable opportunity to resolve the issue informally.
